I don't understand how you get Workman's Comp for an injury sustained while off the clock. I know you're gone on business, but this is clearly not a workplace injury. Worker injured during sex gets compensation payout | News.com.au
They were "going hard" when the light fell according to the male. Uh, no shit, you caused a light to fall from the ceiling.
If she accidentally knocked something on to her while laughing at an HBO comedy special, it'd be covered. I don't see why what she was doing would make any difference.
I know that's how it is, I just think that's dumb as hell. It's not that she was having sex, it's that her hotel stay covered under workman's comp. She was not working, therefore workman's comp shouldn't have to cover it
I'll let a site lawyer determine it, and granted it is in Australia, but she was required to be there by her employer, thus it was in the course of business.
By law it's covered. I think the law is stupid. You work 8 or 10 or 12 hours a day, those hours worked should be covered. You go to the hotel, you're on your own is how it should be imo iyam jmo
If you are required to be on a business trip, and in the lodging your company has provided, an injury occurring during normal human activities would be an injury occurring while at a work-related function. If she was banging a dude at her or his home, this wouldn't be covered.
Seems like the hotel is at fault, not her employer, but whatever. If I were her boss I'd examine her story really thoroughly to embarrass her and kind of even the score. "So there you were getting railed by this dude, which hole was it?"
It's not the employer's fault the light fell and hit her in the head. It's bullshit the employer has to pay for something that the hotel or her insurance company should be paying for.
I have been dealing with comp for years. This is the first I heard of someone coming about a comp claim in this manner. As far as here in the US, the laws vary from state to state.
If you're in your hotel on a work trip, you're someplace that work made you be. That sounds like working to me.
She definitely has a claim against the hotel. She can't double dip, though. At least, I don't think so. I don't know a thing about workers comp except that you waive a liability claim against the employer.
