What if they are trying to close an NIL deal? It seems like none of these rules really apply or fit in the NIL era.

There were no rules at the time. And this was the NIL collective. The letter is 100% correct, the NCAA has an untenable and intellectually dishonest position. Let's go to court. Let's go to Congress. Let's go.
