    [Updated at 10:16 a.m. ET] Kate Bolduan reports that the Chief Justice John Roberts issued a long opinion in which he said the controversial individual mandate may be upheld and is within Congress’ power under the taxing clause rather than the commerce clause.

    Yet another example of Bush's incompetence. He couldn't even properly stack the Supreme Court on the side of his ideology.

    Also saying that states don't have to broaden their coverage of medicaid and that congress can not make the states do so.

    So, the freedom of the states is better protected than that of the individual. Yeah, that's exactly as the founding fathers intended.

    So what was the deal with it gettin reported that the individual mandate was struck down only to have the opposite reported ten minutes later?

    Struck down under Commerce Clause, but allowed as a tax.

    I want to see Roberts give any precedent for a tax that removes from individuals the option of modifying their behavior to avoid said tax.

    Not sure hat, but read this on CNN:


    A previously obscure law mandated that the legality of a tax cannot be challenged until it is imposed, and the health care law doesn’t call for penalties until 2014.
